Contest Rules

By entering the Contest, each entrant agrees to abide by these Contest Rules. This Contest is subject to all applicable federal, provincial and municipal laws. Void where prohibited by law.

The decisions of the Sponsor with respect to all aspects of this Contest are final and binding on all entrants without right of appeal.

Any attempt to deliberately undermine the legitimate operation of this Contest is a violation of TGO Rules and will not be tolerated. Disqualification will result from any evidence of tampering.

All Entries are subject to verification at any time and for any reason. TGO reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to TGO including, without limitation, government issued identification): (i) for the purposes of verifying an individual’s eligibility to participate in this Contest; (ii) for the purposes of verifying the eligibility and/or legitimacy of any Entry entered (or purportedly entered) for the purposes of this Contest; and/or (iii) for any other reason TGO deems necessary.

Forgery and any attempt of forgery shall be deemed as tampering and may disqualify you from entering, participating, winning prizes (defined herein), and preclude you from participating in future contests and promotions, at the sole discretion of TGO. Entries that are late, lost, stolen, illegible, contain false information, are damaged, misrepresented, altered or otherwise irregular with original material, or that do not conform with or satisfy any or all of the conditions of these rules will be declared void.

To participate in this Contest:

The Grow-Off Inc. Awards (the “Awards”) are presented by Grow-Off Inc. (the “Presenter”).

Nominations will be open from____ to _____(the “Nomination Period”).

Entries must have been active/operated/been sold and/or available in full or in part between____ and ____. If entries do not comply with the entry guidelines, they will be disqualified at the discretion of the Presenter. The Presenter is not responsible for any entrant submission error.

Please note that nominations for companies, people, products that are not provided for under the Cannabis Act will not be considered for a The Grow-Off Inc. Award.

The organizer of The Grow-Off Inc. [the “Competition”] the “Company” alternatively the “Organizer”], a registered Ontario company, with a principal business address of 60 Ottawa Street South Kitchener, Ontario Canada N2G 3S7.

Employees, Owners, Principals, or Consultants of the Company or anyone else being compensated in any way by the Competition or its execution shall be prohibited from entering the Competition.

Participation in the Competition is limited to employees, owners, or equivalent persons with a Health Canada issued commercial cultivation and/or sale license. Verification and copies of licenses will be requested. The Organizer reserves the right to manually verify that all provided licenses are valid and in good standing with all relevant regulatory bodies.

There is a non-refundable application fee to enter the Competition. The application fee covers the cost of the clones, the prize purse, award ceremony, and all other costs associated with administering or hosting the Competition.

Closing date for application will be _________, 2019. After this date no further applicants to the competition will be permitted unless expressly authorized by The Grow-Off Inc. Principals.

The Competition, the Organizer, and the Company accept no responsibility for applications not received for any reason.

The prize purse for the winner will be based on the total application fees collected and will be determined by the Organizer.

The Organizer reserves the right to cancel or amend the competition and these terms and conditions without notice in the event of a catastrophe, war, civil or military disturbance, act of God or any actual or anticipated breach of any applicable law or regulation or any other event outside of the Organizer’s control. Any changes to the competition will be provided to the competition participants as soon as possible via email, mail, phone or other reasonable medium of communication, as deemed appropriate by the Organizer.

The Organizer accepts no legal liability, product liability, or any other type of liability pertaining to the health of the clones provided to the participating Cultivation Facilities.

The Organizer is not responsible for inaccurate prize details supplied to any entrant by any third party connected with the Competition.

No cash alternative to the prizes will be offered. The prizes are not transferable. Prizes are subject to availability and the Organizer reserves the right to substitute any prize with another of equivalent value without prior notice.

Winners will be awarded in the categories Yield, Potency and Terpene content/concentration as determined by lab results and reports to Health Canada. Entrants will adhere to competition rules regarding harvesting, drying, curing and sample submission.

These factors may be amended or supplemented as deemed necessary for quality control purposes by the Organizer:

  1. Yield – Total Yield of dried, cured, shelf-ready flower from a single plant (same weight reported to Health Canada).
  2. Potency – Total Cannabinoid Profile from our chosen licensed testing lab.
  3. Terpene content/concentration – Total Terpenoid Profile from our chosen licensed testing lab.

All entrants will receive their clone(s) in accordance with Canadian law and any statutes applicable to the cultivation, production, transport, distribution, or sale of cannabis.

All entrants will complete required data reporting. The Organizers are the only entity that will have access to this data. Our data partners will receive anonymized reports that the Organizers will deliver back to the Entrants in the form of actionable feedback.

All entrants will select and submit samples for laboratory analysis in accordance with the rules of the Competition and applicable Canadian Law and any statutes.

The “closing date” of the Competition will be no later than four months from date that clones are distributed to competition participants. The Organizers reserve the right to amend the closing date as required. Changes to the closing date by the Organizers will be communicated to each competition participant via email, telephone, fax, or any other reasonable medium of communication. The winner will be announced at an award ceremony hosted by the Organizer and sponsors no later than Q4 of 2019. In the event that the winner is not present at the aforementioned award ceremony, the winner will be notified by email and/or letter within 28 days of the closing date. If the winner cannot be contacted or does not claim the prize within 14 days of notification, the Organizer reserves the right to withdraw the prize from the winner and pick a replacement winner. In the event the winning submission encounters legal issues including but not limited to the suspension or revocation of the participant’s license by Health Canada the Organizer reserves the right to select a replacement winner in accordance with the proprietary algorithm.

The Organizer will notify the winner when and where the prize can be collected.

The Organizer’s decisions with respect to all matters pertaining to the Competition will be final and no appeals will be considered or granted.

By entering the Competition, an entrant is indicating his/her agreement to be bound by these Terms & Conditions.

The Competition and these Terms & Conditions will be governed by Canadian law and any disputes will be subject to the jurisdiction of Ontario, Canada.

The winner agrees to the use of his/her name and image in any publicity material. Any personal data relating to the winner or any other entrants will be used solely in accordance with current data protection legislation and will not be disclosed to a third party without the entrant’s prior consent.

The winners’ name will be available in perpetuity at the Competition’s website: []. The Organizer may amend or remove this information at any time for any reason.

Entry into the competition will be deemed as acceptance of these Terms & Conditions.
Any process or procedure not outlined in these Terms & Conditions will be conducted in accordance with all applicable Canadian laws and statutes.
